How I work

Carefully choosing how to deal with a problem, a conflict, a controversy, makes it much easier and more effective to achieve the objectives set, the "result". 

The starting point is an attentive and deep listening to the client, so as to formulate together appropriate solutions, both immediately and in the long term.
But this is not enough: after many years of working I have found that the most effective and decisive approach is confrontation: to focus on the needs of all parties involved in the solution of the same problem is by far the best method to satisfactorily resolve any type of conflict.

My way of working is apparently very simple. But, as all simple things, there is a lot of work behind it.

Esperience and expertise

If you are involved in a conflict, it is advisable to rely on a conflict expert, someone who knows how to handle it competently. I have been carrying out my profession for over 30 years and I have gained specific skills in the field, constantly updated. My skillset includes both the strictly juridical ones and the relational ones necessary to offer assistance capable of understanding situations and the possibility of solving problems.

The Corte di Cassazione (the supreme organ of ordinary jurisdiction in our country) has observed the importance of the "progressive emergence of a new professional figure, with a partly different role and which requires the acquisition of additional relational skills and human, including the ability to understand the interests of the parties beyond the legal claims advanced" . In this regard, in 2018 I obtained the Relational-Body Counselor Certificate after a three-year training according to methods recognized by Assocouseling.

How? There are specific techniques for doing all of this, such as active listening . 

 

However, at the basis of the techniques there must be a capacity for empathy, authenticity, and the desire to understand the client, making the most of his resources, without judging him, without prejudice.
 

It is my belief that the meeting between a lawyer and a client is a meeting between two people on an equal, non-hierarchical level, in which the lawyer makes all his knowledge available to the client so that the latter is in a position to focus on his real goals , his interests , his needs and desires and the possible ways to satisfy them .

Once this is done, it will be the lawyer's job to assist and support the client in devising plans and strategies to resolve the issues in an effective, aware way and adhering to the interests of the latter. 

Creativity

When professionals manage to facilitate such a climate, the result comes naturally, because in a relaxed atmosphere all parties tend to want to reach an agreement.
In disputes, creativity is often hindered by the attacking or defensive attitudes of the litigants, mostly dictated by feelings of fear or misinformation that lead the parties to react rather than act, attitudes far from a broader view of the circumstances in question and from the possibility of being assertive and at the same time respectful, even towards the person of the opposing party.
 

Ensuring a safe environment, based on real human understanding, and free from prejudices, can generate the best conditions for channeling all energies into the search for creative, effective solutions capable of satisfying the client's interests.

As a lawyer committed to collaborative practice, I believe that creativity and positive solutions are the ones that are truly sustainable and long-lasting. They arise in a facilitating and collaborative climate, not in a judging or threatening environment from the opposing party.
 

Balance and Responsibility

However, an assertive attitude focused on the client's goals must always combine with the moral protections of vulnerable parties: if this were not the case, the lack of decisiveness, as well as balance and sense of responsibility could lead to unproductive attitudes, or ultimately induce the lawyer and client to entrust the resolution of the client's problems to a third party (such as a judge) often unaware of the real interests at stake and with little time available to delve into them.
 

I carry out my activity by helping the client to give adequate importance to all their concerns, ensuring that they do not feel projected into unrealistic or unproductive situations, dictated by a lack of clarity or experience on the strategy to follow. Thanks to new work tools, combined with the technical-legal knowledge gained in over 30 years of profession, I can assure my clients that they can manage the conflicts they expose to me and on which they seek legal advice while maintaining clarity, consistency and, where useful, neutrality. I am aware that in judicial (and non-judicial) disputes, affections, people, children, or multiple interests are involved, which the lawyer must take into account and respect in order to achieve the best possible result.  

Tailored approach

Cataloging and using pre-packaged legal strategies does not help to fully understand the client and his needs. I am convinced of the usefulness of maintaining a free mental space, open to all possibilities, to understand how to help my client in the best way, to help him find a "tailor-made" solution, "his" solution. 

All situations are different . There may be similarities, but each has its own characteristics because the people involved are unique and the specific circumstances are unique as well

The experience gained leads me to say that there is never a "standard" case and that it is almost always misleading to compare one situation to another . That is why when I listen to the person I currently assist I am particularly interested in what he is telling me and why.
 

Collaboration

People often forget that children are the greater good, and it is also for their balance and well-being that we can all work together to find a mutually satisfactory solution.

I regularly collaborate with other professionals whenever it is appropriate to meet the client's interests: facilitators (www.bassinoegrande.it), financial experts, notaries.

 

It may seem paradoxical, but learning to collaborate with people with whom you are in legal dispute helps to find solutions more quickly and with more satisfaction. By collaborating, even from very different points of view (sometimes diametrically opposed), it becomes clearer that the problem to solve is not "the other," but the one thing that surely unites us with the other: a problem to solve, a temporary difficulty that can be overcome more easily if all parties involved focus on it, recognizing each other's viewpoints, assisted by one or more competent professionals to not waste energy, to understand the frames of reference, and to more quickly create a better future.
 

Vision

In the unfutunate event that there is already a confrontation, a more respectful and more centered vision on the real needs of the people involved in the conflict avoids fueling it and and instead facilitates mutually satisfactory solutions.

 
This is my vision of a lawyer and of his social function in the declination that I intend to give to art. 4, second paragraph, of the Italian Constitution according to which "Every citizen has the duty to carry out, according to his own possibilities and choice, an activity or function that contributes to the material or spiritual progress of society".
 

In my view, the challenges that life offers us (even in the legal field) are faced more effectively with a confrontation rather than a conflict.


Even when it seems impossible, there is always a way to find a different manner of conversing , with the fundamental help of competent professionals, avoiding times, costs and efforts typical of a battle in court .
It may not appear to be a simple path, because it is new, but whoever undertakes it will be able to derive an important advantage from it.
