Legal Separation

Marriage (like the de facto union) takes place between people.

People change, even within a couple or a family. Sometimes the changes are such that it is no longer possible to continue together on the same path. Separation is a delicate and crucial moment in people's lives, characterized by intense feelings ranging from anger, fear, uncertainty, sadness to hope.

It is a moment similar to the mourning that interrupts the previous life: it is necessary to deal with many things and all together: where to go or where to stay, how and when to see the children, learning to be single parents, taking care of one's finances, replan an emotional and financial life, and so on.
For this reason it is essential to contact an experienced professional who can competently provide all of his support in choosing how to deal with some issues such as custody of children and their prevalent location, maintenance, the fate of one's assets and activities.
There are many ways to deal with a breakup. My way of working and my work tools aim to help the clients understand which is the most effective way to rebuild their future and leave children the right to be children.

Divorce

Divorce is the moment in which the marital relationship ceases permanently.

As for the separation, it can take place by consensual (joint) or by judicial means (when it is the judge who decides on the various questions of the parties).

With divorce, the issues of child custody, maintenance of the children and/or spouse and those other issues connected to the definitive termination of the marital relationship are faced again. Some of these topics will be treated in the light of legislative and jurisprudential criteria different from those of separation, although the terms with which the separation was concluded will certainly be relevant, also given the shortening of the time between separation and divorce.
Only in the event of divorce (and not in the previous phase of separation), under certain conditions it is possible to establish the payment of the spousal maintenance allowance in a single solution (so-called una tantum).
In this phase, it will also be useful to deal with issues related to severance indemnities and the reversibility of the spouses' pension, which, under certain conditions, are donated in part to the other spouse.
I make my experience and expertise available to understand with clients which are the most effective and most appropriate ways to deal with their divorce.

Support administrations and guardianships

In 1996 I decided to accept the invitation that the Tutelary Judges had addressed to some of us lawyers who dealt with family and people law: to take care of covering the role of guardian for people in difficulty. Since then, I have never stopped offering my availability (since 2006 also for the Support Administrations) both to the Court and to private clients. Since then I have continued to deepen the issues related to the help of fragile people, offering my skills in all procedures relating to protection and support administrations, of which I have in-depth knowledge at every stage: appeal/memorandum of constitution, opening of the protection measure, technical consultancy, appointment of the administrator/guardian, requests for authorisations, reports, revocation of the measure.
